You are thinking only about the small percentage of "lost Indians" (including me) who are in this mess - if you really think about your motherland (and mine), help guys like NRN get a good infrastructure in place. Wish I could say something to help those who missed feel better. I was fortunate. My PERM (atlanta center which is another slow goer but nowhere like BECs) got approved on Aug 14. I filed aug 17 but don't think I submitted all needed docs due to unavailabilty of some. I saw some people at Atlanta center wait for much longer than PERM should take and they gave up. My heart goes out to everyone. We do need to become involved with IV...be it those who are ahead in the game, be those stuck in Atlanta PERM, be those stuck in BEC and/or coming out of it now. Each and every person must join so as to fix this broken immigration system. People are stuck in differnet stages and it's not fair, so do get involved and help IV in helping you.

I am one of the unlucky ones on EB3 india who missed the july 2007 bus. With my PD under EB3 India, I know I am looking at 10-15 year wait. So I am planning to switch jobs and apply under EB2. I have done some research and I know that the position and the qualifications both have to match to go through in EB2. Those have successfully ported from EB3 to EB2, Can you guys throw some light on whether USCIS has any specific requirements like salary, previous holders of the position etc etc for EB2. Also, if i apply I-140 under EB2 with the new employer and pay 1000$ from my pocket for premium processing, are there more chances of rejection/RFE due to premium processing?Pls help me get out of the EB3 shit.

since there are many knowledgeable guys here ..I had another question - is there a law which says how the spillover should take place ? i.e. EB2(W) should go to EB2(I) etc ? I wonder why they don't send the extra visa's to the category that is in the worst position ..EB3 - I in this case ?
Only ROW EB3 spillover can make it to EB3 India and as ROW itself is retrogressed, that will not happen.
However, if you check 2007 assignments, Eb3 India got over 10K visas, though the stipulated limit is around 3K.

You cannot combine work and education for EB2 and for EB3 it must be so noted on the Labor Cert.

Education evaluation was not done for bachelors because the Labor only required masters. My attorney is planning to use 2 years of my experience to compensate for the additional 1 year of bachelors degree

not "most"!! only few have a wait of 3-4 years, most have a wait of over a decade....the numbers of applications pending at AOS stage at USCIS is scaryLook at the number of people who posted messages to this thread .... even if you say 4 times that number of people posted messages to WhiteHouse.gov it is no where close to the numbers we need .... Lets not kid ourselves - Unless there is a miracle - most of us are looking at aleast another 3-4 year wait :(

Two H-1B's are possible if you can do two jobs. Most of the ppl file a concurrent H-1B for a part time job so you have one H-1B for full time job and the other for a part time job. The US CIS will approve a concurent H-1B for part time job for as little as 15 hours a week. Now if you want to file the second H-1B too for a full time job and have the physical ability to work for 80 hours a weeks then US CIS won't have any problems with that.

this is an open forum indeed, rarely do people ever get banned or posts deleted. however, with all rights come some duties and civility is foremost among them.
the person whose posts some are objecting to is not a moderator. he is expressing his own opinions. i'm quite amazed that he has been labeled one or put at par with moderators/administrators by some here.
this is indeed an information sharing forum although that's not all it is. i'm sorry the initial poster never got a reasonable reply. really should have.
as for contribution etc, iv or any moderator is not pushing anyone let alone rudely or being abusive for anything. but lest we all forget, this forum exists because this is a grassroots organization with a commitment to removing retrogression. if that goal gets lost in tourism to the forums, then the forums too will be lost too and very soon. just a gentle reminder for you oh so gentle folks!

Do you have 10+3 (Diploma)+1 or 10+2+3(Diploma)+1. If the second case, is 10+2 a requirement for enrolling in to the diploma ?
a 3 year diploma after 10th standard is not a bachelor degree. The US bachelor degree has 16 years of education.
How is the equivalency justified in the evaluation ?

Based on what Sheela wrote looks like it is related with lot of money transfer. I am thinking that is true because of the name 'Immigration and Customs Enforcement'. If it is related with just immigration then I don't think Customs Enforcement will come into picture. bujjigade123, did you do lot money movement from US-India-US? Why did they visit your employer 2 months back? Do you know what they asked your employer?

Talked to an io at neb sc.within 5 sec of me starting to talk the ffice interuppted and she apologosed for doing that and said because of huge vol of appli there is a delay in the receipt notice.i SAID I AM july 2 nd filer and she said it might be in the first week of aug..(i had said the same thing in my earlier post too after i spoke toa diff officer)..She asked to keep checking the check clearnace.

This is a really good initiative. I appreciate the IV core for taking this up. I have read enough stories from people on Murthy forums. I will ask people on those forums to post their stories first hand on IV forums.

So after more than a month of sleepless nights, thanks to Immigration Voice looks like my I 485 application is back on track.
A recap of my situation:
Last month I got an email from USCIS-CRIS stating that my I 485 was withdrawn. After being in this country for close to 10 years and in the immigration queue for more than 7 years why would I withdraw the application ??? I did not withdraw my application !!!
It took me more than a month to find out the reason behind the withdrawal..trust me it was not easy..and guess what ....It was my Attorney who had withdrawn the application in Error. Now what ... I call USCIS multiple times.. talk to many different IO's .. some of them patient and try to help.. some extremely rude.. but all of them had only one thing to say... they cannot help!!..... I get an Info Pass... no help there either.. I set up an emergency meeting with my attorney (one of the large Immigration Law Firms) .. nothing...they accept their mistake tell me that they will do all they can .. but no assurance that they will reinstate the case .. limited forward movement.... things look gloomy and bleak..no one can help me.
Then I called Immigration Voice on the number that is listed on the site and left a voice mail. Promptly got a call back I spoke to a Core member who understood the gravity and urgency of the situation and swiflty moved forward and got in touch with their contacts in the government. The Core member also put me in a conference call with the person who was going to look into my case, I was so relieved that I could explain the situation first hand.
I got a call today and I was told that after evaluating my case my file has been reopened and they have mailed an offical notice regarding the same and I should get it in a few days. *Fingers crossed until I get this notice in hand ;)*
The IV core was extremely sensitive to my situation and were very responsive and extremly helpful. I cant thank Immigration Voice enough for helping me resolve this issue in a quick manner.
I have registered to be a recurring contributing member and I intend to be an active member of this group.
My lessons from this crazy experience are:
- Never trust your attorney, always ask for a copy of any letter/document they send to USCIS on your behalf
- There is no organization besides IV out there that is looking out for the interests of the Immigrant Community.
- We need to strengthen IV in all ways we can, we need to be active.
- And as so many members have already said "We are IV." If we want things to be better "WE" need to do something about it.
I urge members who are still contemplating becoming active members to evaluate their options and to become active and contributing members of IV.
