same story for me, i just moved to different unit in the same apartment. everything remains the same. Same city, same zip code, same employer.. Somehow i believe address change triggered the RFE. Probably the change in the file pushed my file in FIFO and someone looked into it and gave a RFE. Will have to wait till i get the actual letter.

With the kind of response I saw at the House judicary commitee inspite f making all those calls . I now realize where we are on their priority list , below horses .
Sorry for the sarcasm , I am pretty bitter about the whole thing now after 2 repeated delays .
Even I was under the same impression, but some members like sanju et al say there are still chances and GC issues are on top on the priority list. So lets hope for the best

Certainly the layoffs have been on the steady rise since last quarter of 2008. Most layoff's i have heard were either in Oct 2008 or Feb/Mar 2008 and mostly for contractors.
So layoff's are definitely happening, but a lot of full-time emplyoyees are doing better than those in contracting.
in my area i have seen around 350 contractors laid of by a insurance company and also downsizing in the state workforce.

Hi Prinive,
I too am in the same club, having a priority date of Sept 2001. I am still awaiting my I-140 approval, filed in March 2007.
Hoping things would be sorted out sooner rather than later....I am in EB-3....How about U??

I have a question regarding use of EAD and living in Canada

Currrently, I work on H1-B and am living in Canada (I cross US-Canada border everyday)
I am also a Canadian Citizen and used that to cross border everyday. So, far I never used the EAD
I recently got laid off, and planing on using my EAD for my next employment.
Questions
Once I start using the EAD, can I still live in Canada and work in US.

You should read that RonGothers thread - he is strongly of the opinion that maintaining H1B status while AOS is pending is useless. Moreover, it seems like USCIS can revoke your remaining H1B when they deny AOS application basically kicking you out of the country immediately. Now as a practical matter, I don't think they are doing that anyway. So guys, once you burn up your 6 year H1B, there is no real strong cushion if 485 gets denied. To heck with these laws. Stupid and irritating.

Below is data of PD from last four years for EB2-I - only for Jun, Jul & Aug.
Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?

1) DOS seems to make sure no visas are wasted and so may not want to wait for the last 2 months of the fiscal year.
2) More cases are pre-adjudicated which makes it easier for them to initiate the fall-across/fall-down in July than wait for August.
3) DOS has been good at not retrogressing the the visa dates further back in the last few months. They either stay where they are or move forward. But not back. This indicates that they are paying more attention and not randomly opening up visas. This means they want to issue visas by priority dates which would need proper planning (to make sure nothing gets wasted)
All these above factors may influence them to open up in July than August. Again, these are my gut feel.

Your AP is most likely approved. The LUD on AP is generally an indication that they have requested it to be printed. (Similar to card production ordered). Unlike EAD there is no status associated with this, in another few days you will see the status changed to Document Mailed to the Applicant. This is for everyone with LUD on AP without change in status.
Folks i got a LUD on my AP 7 days back and again LUD 5 days back. But the status didn't change nor i get any letter of so far.
Does this means i'm on my way to a RFE :) If they send RFE does that gets reflected on the Online Status ??

Hello,
I just received an RFE for my dang travel document as well. They want copies of all my passports, with arrival/departure stamps and more photographs. I travel abroad every other year so this may have kicked off the RFE. I'm sure all the lawyers are loving the RFE's. I cannot believe we have to go through so many hurdles for just a I-131 travel document. It looks like they are going to make us work for our green cards. :confused:

We don't contribute less. We work no less than others ..but yet we are discriminated.
I wonder why they don't have 7% cap on H1B . And all this stupid media says people from ...... are stealing jobs and ....... overstay:mad:

Guys,
Not sure whether my suggestions help any one, but I do have some real time knowledge about this process.
You can do EB2 with following options
1. A bachelor's (4 year degree) + 5 years exp. This exp should be with prior companies.
2. Master's with no minimum exp.
I am assuming you guys already have knowledge about EB2 requirements and skills. Basically, there is nothing in IT, which needs Bachelors or Masters. Requirement is defined by HR on advice by Attorney. Any job requirement can be defined as some thing which needs a bachelors or masters.
My company applied for me and another guy under EB2, since both of us have master's degrees over here. But, for another guy who had 7-8 years of prior exp, my attorney applied in EB3. This guys is a dev team lead and is one level above me.
By April 2008, we had our I-140's approved, but this guy (in EB3) doesn't know he in EB3.
Accidentally, I found out when I am cross checking with him regarding H4 extension for my wife, whether he did it on time for his wife.
We forced him to talk to HR and Attorney and they agreed to do EB2 for him.
Attorney simply filed I-140 under EB2 using his EB3 labor and it was approved in 4 months.
We are confused about this whole process, but it worked for him. May be some of you, who falls in this category can try doing the same with out actually changing jobs.
Another option for people who are using EAD. I am encouraging one of my colleague to get him to talk to HR, to apply for EB2. He doesn't have H1, but one doesn't need to have H1, when they have some thing like EAD. They can use EAD to change job and start the process again, but once their ported old PD with new I-140 was approved, they will be ready to file new I-485. This will reduce their waiting time a lot.

I somhow feel that Name Check problem has not been taken care of within its entirety. I agree with one thing that NC will be "improved" but has not been and will never be streamlined the way actually it should be.

waiting for NC check... What if USCIS decides to keep 100000 cases on
rack eating dust just by not moving the processing date for particular
service center? This you can see right now.. USCIS is making Texas slow
day by day not moving processing date. I remember Texas was ahead
with comparison to Nebraska around May to August 2007. If this happens your case is no more "processable".. Yes you can say that you are not stuck in NC queue but you will be stuck. USCIS may come up with altogether different startegy... To align processing times with FBI processing and FBI NC initiation. That may screw the things further.

I have a similar question. I have I-94 till Jan 2008 as my H1B visa is valid till Jan 2008. If I file an H1B extension in Dec, is that okay ? I know, approval would not come before Jan 08.

I like ur idea, can you design this or get someone to do this. It still has to have the same basic principle. we all have ideas we need someone to actually do this since we are mostly IT folks with programming skills can we get a volunteer or a group of volunteer who can do this?
I do not know whether this is going to help IV raise more funds or not, which should be the bottom line for every effort spent at this crucial juncture.
My thoughts on this scheme - Instead of going to outside web sites, we can design a scheme locally ourselves.
Currently we have member information like EB2/EB3, what stage of GC processing etc ... We can add another read-only field to this information like range of contribution by the member. For example,
Platinum member > $1000
Gold member $501 - $1000
Silver member $251 - $500
Member $1 - $250
Non-contributing member $0
When IV can come up with member, senior member etc ... depending on number of posts by the member, even this categorization can be easily implemented in the database. The exact dollar amount need not be disclosed.
I do not know whether this is going to help IV raise more funds or not, which should be the bottom line for every effort spent at this crucial juncture.
