In short that forum story as follows :
On 6th Nov 2008....
He thought because of unemployment application, Two(2) Immigration Officers + One(1) State Police Officer came to my house a 6.00am in the morning questioning my �Legal Status� in this country.
But that found wrong reason as per his latest reply on 3rd Mar 2009....Immigration Officera turned to his door due to his Employer informed USCIS about his firing while revoking H1B.

Hi All, Went to the Immi court today and returned just now. My lawer had prepared a wonderful document "Motion to Terminate Removal Proceedings" and Pleading document. DHS was presenet. Since there were number of attachments with evidence, the court has given a "Individual Hearing" on July 6th Monday @8:30AM. My lawyer is pretty confident and it should be fine. I am one of the rare cases. I did see the judges list on notice board and did not find even one Indian name other than mine. Will keep all posted when things progress. Thanks for the support. Sheela Murthy okayed Unemployemnt benefit. So if one wants to file, go ahead.

Thanks for posting a very relevant question, I am in a very similar situation, my labour has not yet been approved (was applied in July 09'), i think 2010 is a defining year of immigration drain.
The EB backlog is out of control now....eventually people will realize and take the necessary
decision of leaving US.

Guys, I wanted to circle back and update you on the results. My I140 was approved today and this is what i had submitted as alternate evidence. Hope someone else will benefit from the details I am putting here.
Thanks to you all who took time to reply and assist me on this issue.
Documents submitted:
> Experience letter non-availability as an affidavit mentioning that we tried but previous employer did not provide the letter.
> Email trail of communication with ex-employer detailing communication asking for exp. letter.
> 2 affidavits from previous co-workers detailing job responsibilities, skills, dates employed together.
> For 63 months of last employer experience, paystubs, W2's, Indian Form 16's, Indian IT returns, yearly appraisal letters, other evidence related to employment(not all but whatever was available).
RFE was :

It only makes me wonder how many more applications with PDS older than 2001 (substitution or not ) from India are still pending :( . Good luck to all of you guys who has PD older than mine (Sep 2004 EB3), unless you are out of the queue I dont get mine :)

Buddy, what were you doing for 40 days after your got terminated? If you knew it was coming you should have made efforts to transfer H1 or right after. If you transfer H1, then obviously INS will look for pay stubs etc from the last sponsoring co. Since you mentioned you never actually worked for them (if I understand this right) then you are in trouble. You can use EAD but you lose your H1 status. If you want to get back to H1 then you are back in the lottery mess to qualify for one. Obviously you need to decide what is important to you at this point. Marriage or your job/GC. Good luck.

My I-140 was recently approved. 140-485 filed concurently in July 2007. I have a new job offer and plan to use AC21. However I am worried because the wages at new job would be significantly higher than the old job. There are two reasons for the big difference
1-Desi employer v/s corporate employer
2-Dallas v/s New York
Any comments from people who have faced similar situation will be highly appreciated.

I said I will get stamping done before I return from India for the first time. That way the action of getting I-94 at POE upto Feb28,2007 by official does not arise.

I just realized that I should probably provide some more details about my situation, which must appear very confusing right now. I came to the US in 1994 with my parents. Yes, I have actually attended from first grade through college graduation here without a green card. My parents have been screwed and screwed again by their employers and the system. Right now we're on my dad's 140+485, with an RFE just sent out for the 140. Try beating our story for fucked up.
One reason I'm making this thread is that I want to make sure my judgement about whether to go or to stay is not clouded by my inherent bitterness toward the US and its government on the one hand, or by an unrealistically rosy picture of what to expect in Canada on the other.
I greatly appreciate all the honest replies that have come in.:)

From what I know TN visa is not dual intent like H1B.

So you can't continue processing your GC when holding a TN visa.

if you have EAD and 140 is approved (And 180 passed since 485filed), then why are you worried about H1 status ?
am I missing something here ..I let my H1 expire and am using EAD now.

I read in some other thread. I believe that you can be unemployed till you get I-485 approval. If I-485 is not yet approved, then you become out of status and in the case of no fall back upon, one needs to leave the country within 180 days.

Basically, there are lot of people on the other site, who don't want to join IV but participate:) They think that they might be accidentally causing a benefit to IV by joining IV:)
This seems strange...no reason you cant be a part of more than one organization
and what kind of benefit as we talking about here?
are they also EB immigrants with the same Goal....do they have other different goals?
They want to come help with advocating...but do not want to benefit us...so they want to benefit us by helping out but they don't want to officially be seen as benefiting us?? lol seems like a weird funny paradox :D
Maybe they can help with logistical support n let IV deal with the actual talking to senators part

It's ridiculous how people start to bad mouth everything related to US once they get a PR from another country, especially Canada. It�s like kicking off the same ladder that you used for climbing.
1. You gained entry into US with the �toilet paper�.
2. The �toilet paper� allowed you stay legally in this country.
3. The legal stay enabled you to apply for Canadian PR from Canadian Consulate General in Buffalo where the processing time is less than 2 years.
4. The legal stay enabled you to earn sufficient funds which you showed as proof of funds in your application papers.
5. The legal stay enabled you to get police clearance certificates from FBI and also from your country�s consulate in US.
Now let�s say you didn�t have this �toilet paper� and applied for Canadian PR for India.
1) You would only be eligible to apply from Canadian Consulate General in NewDelhi where the processing time is more than 5 years.
2) If you are from a middle class background, then you would have a hard time in providing the proof of funds for a family of 4, with your earnings from India.
3) You would have to grease the palms of police to get police clearance certificates and they are gonna take their own sweet time to provide you these documents.
Now be thankful that you got away from all these with the �toilet paper�. And remember that you are leaving to Canada not because of your love for the country, but because you didn�t get your US GC on time. Sour grapes, huh?

Ron is a very good person and a very competitive attorney. RK's charge was (very high) for main applicant and (still high) extra for each of the dependents. (This was on his website. check with him before you blindly believe me. Murthy never replied to my email, most likely interested only in corp clients I guess.) This was way more than I could have afford. RG charged only (fraction of what RK charges) for entire family and he offers superior service. I am 200% satisfied. I recommended him to many of my close friends for AC-21.
