Guys, I submitted my app on July 2 with matriculation as BC. I'm OK with RFE... Do you think it will be rejected????
I don't think they will accept matriculation certificate as primary evidence. Since the birth certificate is initial evidence, you should contact your lawyer ASAP.

They should also allow people from Backlog Centre (PD 2001-MARCH 2005) to file 485. Looks like they really cant make any impact. How many more years to wait just to file 485 ? Oh Gosh....

I have a similar question. I have I-94 till Jan 2008 as my H1B visa is valid till Jan 2008. If I file an H1B extension in Dec, is that okay ? I know, approval would not come before Jan 08.I beleive as long as u dont hear something from USCIS u are still in status provided u filed before the expiry of ur I94.I also think they do send a new i94.

What happens to an employee at any company who has done something positive but has been caught abusing his colleagues a few times. He gets warned by HR first and then gets fired right.
We have lot of things to focus on to get relief for our community and there is no reason to tolerate this behaviour towards fellow members.

Why should a drivers license be used as an ID ?
Even if it is an ID, it should NOT be linked to immigration status.
An ID says this photo and details are of the person holding the ID. It is meant to "identify" a person NOT for checking the immigration status.
If someone needs to check the immigration status, they should ask for immigration documents rather than a general purpose id.

Ron Gotcher believes EB2-India will be somewhere at 2002/2003.

For most Desis, immigration attorney is GOD. And the words coming out of the mouth of Immigration Attorney is the ULTIMATE TRUTH. We as desi community is happy to hero worship someone who kicks us everyday by conspiring to delay our green card application, not pick-up/return our phone calls/emails. That's how we as desis love, to be treated as trash. That's why we worship immigration lawyers as GODs.
In my opinion most immigration lawyers are part of Employer-Lawyer nexus to exploit employees. Most lawyers are in the business of finding loop holes to make more money for the employer (NOT EMPLOYEE).

Hello,
I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).
For one thing - there would be thousands of applications between 07/19 and 07/28 (mine being one of those :D) and the other is that the USCIS doesnt pre-adjudicate. Since the PD has only moved recently, the processing dates didnt move that rapidly

Just a quick update
Today my checks got cashed and from the back of the checks I got the receipt numbers. I was able to track these numbers on USCIS site and the EAD application for myself and my wife is now pending at TSC.
So the mailing address to Mesquite, TX turned out to be the correct location for me to file...

Someone posted a link describing I-485 Standard Operating Procedures. It is very detailed and interesting to read. It even described color of paperclip to use, place it on left or right corner, how to fold papers, how to form group family cases, how to shelve and label them, etc. It also has a very detailed description on where to click on screen while working on cases. Thank you so much for your responses! I did not mean to lie to the consulate when I answered "no" on the form the previous time. I think the thing that we've actually came back in time proves it.
This is not a valid reasoning. The "no" is not related to immigration intent. It is related to if you made factually correct statements.
The new DS-160 form doesn't have this questions because I've heard that many people were confused by it. The consulate officer did not ask us if we were planning to immigrate to the US. I know of quite a few people who were issued a non-immigrant visa while replying "yes" to that question. Does it mean the law was broken on that case?
Does it matter if the "I-130" was not approved yet? Does it count "immigration intent" from the date they've received documents from my brother? Please comment. Thank you.
You need to *prove* that you have no intention for immigrating to US. Your intention is within your head; it does not start from any given date or given action by USCIS. The IO needs to "read your mind". The legal standard is that the court concedes that no one can know for sure what one's intentions are, however, the immigration officer can make a reasonable guess at the intentions by observing the actions you took or someone else took on your behalf.
In your case:
1. Someone filed I-130 for you. This is for permanent immigration to US.
2. You have family ties in US.
3. You have traveled to US before (I do not know how frequently).
4. You want to join a university that does not even have your major; that too you do not know what exactly you will study in that university. This itself is a very strong indication (at least in my mind) that you are not really interested in the education, but you applied to that university just for coming to US.
All together, it shows a clear pattern of observable evidence that your intention is to immigrate to US.

According to what I have read - porting of PD can be done at 2 stages
1. At the time the second I-140 is applied or,
2. When one applies for the I-485.
So you should be fine going by #2. Not an attorney, just like you all - a GC aspirant commenting on his research.
My question is the same that you raised earlier - the Memo states that the PD has to be current when interfiling. But in the case of pd_recapturing, his PD is May 04 which is not current - EB2 for India is Apr 04 (my assumption being that pd_recapturing is from India.)
My case is exactly as pd_recapturing, waiting for the approval of my second I-140 to see if the date got ported or not (we had requested during filing of second I-140). After the approval, I was thinking of waiting for my PD to be current before filing.

Ok, just back from the doc. Took around 2 hours . Charges - $340 for adults (Includes Physical, Blood test - HIV, Hepatitis, Syphylis, Tetanus shot), doesn't include X-ray ($80).
Good thing about this place is, they do X ray, Blood test inhouse. SO you don't have to go out (means another appointment).
Right now they are doing extended hours, Dr.Anand Patel told me that appointments are full till July 4. But they do take walk in.
Go on a weekday at working hour.
