If he is going to start with new PERM. new I-140, he can port the old PD based on old I-140.
I disagree based on the following:
Accordingly, guidance in the June 19, 2001, memorandum provides that the labor
certification or approval of a Form I-140 employment-based (EB) immigrant petition shall
remain valid when an alien changes jobs, if:
(a) A Form I-485, Application to Adjust Status, on the basis of the EB
immigrant petition has been filed and remained unadjudicated for 180
days or more; and
(b) The new job is in the same or similar occupational classification as the job
for which the certification or approval was initially made.
note the "and" between (a) and (b) and note point (a) which states that a pending 485 is necessary for an alien to change jobs

Lately the members of IV have come to know that Aman Kapoor, the co-founder of IV has sold his house and spent around $64000/- towards the administrative costs of IV. This too was brought to our attention from a regular member like you and me, without which this would not have come to our knowledge at all.
So some of the members have taken an initiative to reimburse Aman and other core IV team members with the expenses they have incurred so far towards the administrative costs of IV. Note that the time they have spent and the sufferings cannot be compensated. Let us do the least by atleast compensating the money. Please do not donate directly to IV funds.
There is a funding drive in this other thread towards reimbursing the administrative costs of IV.

Good news could only be this. Accept I-485 and issue EADs. Country limit cannot be removed that quickly. I think a legislation needs to be passed to be in effect. What say??

possible reason for mysterious rejections :
You are a mail room guy, you go home friday (06/29) and comeback on monday (06/02).
You start the monkey business of timestamping incoming mail, but half an hours into the day (around 8 or 9:00 am), you realize "sshhttt: i did not change the date on my stamp, its still read 06-29-2007". In the classical govt. fashion, you do not bother to go back and restamp the applications with the correct datetime. Not because you are evil, but because you simply don't understand the ramifications of early stamping. You think u are doing the guy a favor, putting him/her early in line.. but guess what... the guy's application is gonna get rejected.
Could this be the case with some apps mysteriously being rejected?

No offence to anyone. Of all the drama that was going on from Jan 2006 until now, I feel (+ve) that our issues(EB relief) will be taken into consideration only when they come to the topic of making the illegals into legal residents of this country. Any immigration debate in Congress cannot be taken up without considering the Illegal Issue.
We will see and will be surprised to see that an illegal will be granted a status independent of an employer and will also have the travel permit and he/she can live here forever renewing his status.

porting can be beneficial but attempt it only if you are 100% sure that it will succeed and talk to your lawyer before you do it and don't attempt to do it yourself. it will be a lengthy process with increased scrutiny. 3-4 months for labor and atleast 1 year for 140 processing and moreover DOL is making it tougher for EB2 with strict adherence to the rules and increased scrutiny. after all this, there is a very high likelihood of getting RFE from USCIS at 485 stage. if any EB3 person has EAD, AP then it would be best to play it safe and stay with EB3 as you already have the benefits of EAD and AP. I know it would be much much better if you have a green card, but would you have it safe and sure or do you want to go through all the stress of refiling and preparing for all the problems in the process? it should be ones own personal choice. moreover I am hopeful that things will move favorably after the elections with the immigration reform and might result in some relief for all EB categories

With the new rule on FBI name checks, a potential 47K with current PDs could get their GS's soon. I wonder how much of a shift we will see in the PD's from now, after the 47K is not taken into account. I would predict a minimum of atleast a year jump, or am I being optimistic. :confused:
Some one pointed out in another thread, that the USCIS FAQ mentioned that only a 'subset' of the potential 47k cases have namecheck pending for more than 180 days. So may be not all of the 47k cases (even those with current PDs) may be eligible to qualify under 180 day FBI namecheck auto approval rule. Thus not all 47k cases will be approved by the mid March deadline that USCIS mentioned.

I would support this bill since it makes a lot of sense. I am not going to benefit from this since I have masters and not PhD but people who have sacrificed the lure of big money to live on campus with 2-3 roomies for almost 5 years in which time their friends who graduated are driving lexus and staying in 5 Br homes need some consolation prize. This is a great move for these students as well as the country.

Chandu is one of the active folks/volunteers who is helping us more that we are helping ourselves... His push and constant nagging are coming as +ve reminder who couldn't send letter due to hectic schedule or are still Procrastinating ( there is a huge chunk of people like this ) . At the same time there are a certain gang of folks who will never send letter , never support anything - just eat the fruit of other's labor and be proud and happy !!!
My personal request to Chandu would be - Pls continue the push and nag but keep it above the beltline. Let's not create 5 threads but do the push 5 times in 1 thread.

Nothing wrong in posting threads that help support a cause. My question to all those who are attacking me - why are we fighting among ourselves? Why can we not work towards the goal?
