on 630 KHOW (Capliss & Silverman).
Congressman Udall spoke at length how the conference committee is formed, how it operates and how decisions are reached.
One thing he said is particularly noteworthy. He said, he reads his fellow congressmen and the mood of the House, and at this moment there are 300 congressmen (out of a total of 525) willing to vote in favor of the senate version of the comprehensive immigration bill as it is.
As I said in my posts elsewhere in IV, let's keep our eyes and ears open for the opnions of representatives and follow up on that.
300 out of 435 Reps is a huge and victorious number! Or, did you include the 100 Senators in the broad definition of Congressmen? Even, then 300-67 = 233 is a successful number in the House!

I have a valid point to akhilmahajan.
I work for security industry (database auditing) and i do know the concerns and security related issues.
Here USCIS may be sending the information of one applicant to the other applicant. This may happen with a probability of 1 in 100.
Now tell me, what will you or i be doing with someone else's data?
Atleast skilled immigrants like us will not harm and or destroy knowingly someone else's credit history. This will not only destroy your future citizenship options but will also lead to deportation in case you are caught.
Also, there will no credit card numbers and or bank account details to be lost.
One more thing is, you can always fight back and reverse the screw up that may happen in case your social security number is misused and you have a proof of it.
By saying this, what iam saying is, the threat is not as serious as the thread author seems to indicate. There are bigger concerns on our plate who needs our attention.
Unless the USCIS mistakenly publishes your data on website and or looses hard disk with all the data in it at walmart, you shouldn't be worried.
Peace.
I hope i did not offend you.
It looked to me a valid point.
Anyways, everything is all set now and i hope this does not happen to anyone.............

I am all for abonding H1B, when did IV promoted H1B program, we have this mess today due to H1B and itz loopholes,
I don't use word slave very lightly, but we need to accept the fact many of H1Bs are handcuffed with current system, We need system similar to Austrialia, Canada a point based system or very similar to Nurses in US they get GC before even coming to US.
H1Bs are truly pulling the wages down, I know I did when I came here I have no argument with anti-immigrants with this subject, but giving GCs to these H1Bs will have fair chance to compete in Market
Corporate leaders such Bill Gates and Senators such as Kennady do know this issue and have deep understanding but they don't give a rat about it,
eb3India,
Are you out of your mind? It is one thing to be ignorant and it is entirely different to be an idiot and foolish. A delay with green card is driving you insane. Please get a grip on yourself.
No system in the world is 100% full proof. There maybe some problems with H1b problem, but that means system needs to be twicked, not abandoned. People like John Miano are always looking for posts like the one above. So just to win a point you are posting irresponsible comments, the once that could easily be found on any anti-immigrant websites. That’s why you are not just ignorant, you are idiot and foolish. Please post responsibly. It is the least that is expected from a highly skilled person like you.
If you are not qualified enough and if you don’t add value to your employer, accept it and leave. Why do you think that you are a representative sample of the entire H1b community? There are lots of people on H1 who make their employers competitive and add value to their place of work. They are not driving down wages and your generalization of the entire H1b program to support your idiotic point about “slavery” is WRONG. It seems you have a very low self esteem.
Delay with green card is not a valid reason enough to throw blame on everything around you, including blaming H1b program. Your attitude is ‘the door shuts right behind me’ and then you find reasons to justify your attitude. C’mon man, get a life.
On a different note, can you guys do/contribute in any better way than to change the name of the organization? Is that the best WE - THE BEST AND THE BRIGHTEST - THE HIGHLY SKILLED AND TALENATED can do, change the name of the org and expect things to change for us?

Hi,
I self e-filed my EAD application and the Receipt date is 6/7/10. They called for Biometrics which is done.
I got an email saying that they have sent a RFE. Waited for 10 days, still no signs of RFE. When I called USCIS, they asked me to wait for 15 days. When I called after 15 days, they created a Service Request to re-mail the RFE. Now they say, I have to wait for 45 days. When I asked them if they will extend my deadline to reply to the RFE, she said she doesn't know.
Has anyone been in this situation ?
What kind of RFE will they send for an EAD extension.
I sent my 485 receipt and a copy of my EAD when I e-filed.
How many days do they usually give to respond to the RFE ?
Any feedback is appreciated.
Thanks.

I dont know what to say about you. I have complained to admin about your derogatory posts. Admins will be taking appropriate action on your account soon.
Even though i requested so many times in many threads, and bumped contribution thread you never thought of contributing to IV, did you? did you ever even cared to look into contribution thread Mr. Smart:rolleyes:
People who come here just to create threads and post all silly things need to get remind that this forum/organization is ran by members contribution, people like me who are contributing are allowing you to use this site. You better get this.
And somebody said it right, to contribute someone has to be huMAN.

bsbawa, really.... what were you thinking when you typed this? :)
This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?
You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
The credit card will be charged once, may be charged twice or a valid CC may get rejected.
Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
There would be an online survey after you buy it which would never get submitted 99% of the times.
In case it did get submitted, somebody will read one out of 10,000.
After reading it he will throw it in the trash can.
If you get a defective TV (which is quite likely), you have a chance to file appeal by paying the same amount of money for the TV again so that your case can be re-opened.
I wonder how many customers would USCIS have eventually ??? Any guesses ??? :-)

Recently I spoke a IO at NSC and she specifically told me that the local office does not see if its assigned to an officer or not. All they see is what room it is in. Ironically, the rooms names are like name of a person.
So it may not be with an IO realistically. The infopass information may not be the best answers you get.

Guys and Gals,
I decided to go with my credit union and called them this morning to lock the rates. I just received some disclosures and rate lock agreement, when I was reading it, there was a section where it asks "Are you a U.S citizen?", loan office assumed that I'm a citizen and checked the box.
I understand that I should tell them the truth, but wondering if that may increase my interest rates. Please share your experience or advice you may have for me.
H1B - Valid till 2011
EAD - Expires on Sept 08 (will be renewing it soon).
You have to inform that you are in H1 ...Mention to them that you are processing your green card.I own my home for the past 4 years. At first she was hesistant and later she did work out great rates for me.Actually it does not matter.

My case is exactly like yours ....
1st 140 under EB3 PD Oct 04
2nd 140 under EB2 still pending, requested for EB3 PD Oct 04 to be ported - awaiting porting results.
However, since your 485 is already filed with a EB3 I140, you are requested USCIS to 'link' (for lack of better words) the new EB2 I140 with your pending I485. Per my interpretation of what I have read in Matthew Oh's website (I'll post later) and Perarson's memo, we can request this interlinking only when the PD for our 2nd I140 is current.
However your lawyer suggests differently - which may be fine and may work just as well. In fact, if your case works, then I won't wait for my PD to be current either and will interfile immediately after approval of my I-140.
here is where my confusion lies....I'm sure you must have this also.
This posting involves aliens who are waiting for the I-485 applications where the underlying I-140 petition was approved but due to retrogression, I-485 cannot be approved. Most of these cases are EB-3 cases. When the same alien obtains an EB-2 labor certification approval through the same employer or a different employer and the visa number is available for the EB-2 for him or her, he should be eligible for filing another I-485 application based on the visa number available EB-2 I-140 petition. This can be achieved either by concurrent I-140/I-485 filing or if the new EB-2 I-140 has already been approved, by filing of stand-alone I-485 application.
However, in the foregoing situation, the Pearson Memo of 2000 allows the alien to transfer the pending I-485 application from the existing underlying approved I-140 petition to a new EB-2 I-140 petition such that the alien does not have to file another I-485 application to use the second I-140 petition. For this to happen, two conditions must be met: (1) The existing underlying I-140 petition (most likely EB-3) must have been approved before the I-485 transfer is requested. (2) Secondly, the visa number must be "current" for the new I-140 petition (most likely EB-2) before the I-485 transfer is requested. Inasmuch as the visa number is current, the pending I-485 application that suffer from the visa number retrogression can be transferred to the next I-140 petition.
Please share this with your attorney and update the forum members of their response.

I totally agree, you should first have an RFE in hand and the decide if it is urgent or a simple one which one can handle.......... if URGENT then do search threads to see what solutions are stated, if none match your criteria then you are welcome to post on a new thread.
Without RFE in hand, you will only get unrelated answers, instead of giving you solace it will worry you more. Like people might suggest, your old employer may have revoked your petition or you might have done something wrong in filing for AC21 (IF you have done that)............... so let it just come and then decide.
Since this was your first RFE , do not worry. I believe all of us pass through this stage of RFE , now it may be at any stage. I too got mine on 140, but gotaway with it.
Relax you will be fine.

I'm afraid of same things too...Hope something will work out.
Based on Assement in this article, it almost seems that the chances of STRIVE are dead even before it goes to House Immigration Commettee. I am not trying to be negative or something but the article has such a tone. I can understand that Pelosi did not schedule any timing but what concerns me most is the fact that
"California Democrat Zoe Lofgren, who chairs the Judiciary Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law, will hold hearings before marking up any bill"
Now we all know how one sided these hearings are and how long they take. In nutshell these hearings give chance to any tom, dick and harry to express his opinion and create melodrama. We already worry about melodrama of people such as Sen Sessions in the Senate. Add this drama, and it can easily eat the short window we have to get the relief. I really hope I am wrong here but I have a bad feeling about this :(

The name check takes 2 years anyway, making a mockery of fast processing times. Even VSC, which is the slowest, takes less than 2 yrs for 485.
Wait a minute; I thought the name check is part of the I485 approval (and for those who file I-140 and I-485 concurrently, part of the I-140 approval). It wouldn't make any sense if the I-485 is approved and they are still checking the identity.
Also, the thread has been quiet due to lack of hope regarding the speed of processing centers (Wata, I am with you on the Nebraska one) and the unreliability of promises for improvements.

I am confused because I read that you have to declare any foreign accounts held.
This applies to US Citizens ...it may apply to you if you already have your green card...but i am not fully sure about this....and i am quite sure it does not apply if you are on a work visa

Dude,
http://www.flcdatacenter.com/CasePerm.aspx
There are MS Access database files for each year.Depending on which year your labor is filed, download the Access db.
For eax, mine was Dec 2002.I downlaoded 2002,03,04.My record was found in 2004 database.
If you open the Access db (You need to have MS Access to view these files. If you dont have it, downlaod the free trail version from microsoft.com)
If you open the file, it is the database of all the Labors that are filed in that year. One of the attribute is the Employee name. You can also search on Attorney name.
If I were you, i would first filter on Employee State and then search for the Employee name.
Its simple.Try it and let me know if you need further help.

Good luck
