I wrote about our retrogression problem to our senator Barack Obama three months ago and I got reply from him today.I couldn't find the answer to my question.Can you help? Here is his response:
Thank you for writing me regarding immigration policy. I have heard from constituents on both sides of this issue, all making passionate arguments. This is unquestionably a complicated policy challenge with far reaching ramifications across society.
After much study and discussion, I have concluded that the best course is to pass comprehensive reform that reaffirms the rule of law and brings the undocumented population out of hiding through an earned path to citizenship. In my view, the approach presented by the immigration bill passed last year by the Senate lays the foundation for such a permanent solution.
To address the immigration problems in our country, that bill put forth a three-pronged response: 1) it strengthens border security; 2) it establishes a path to citizenship that included fines, a requirement to learn English, and adherence to the rule of law for immigrants and their families who may have entered the United States illegally but are now contributing and responsible members of society; and 3) it creates a "guest worker" program whereby American businesses can temporarily recruit foreign workers for jobs that American workers cannot or refuse to fill. This proposal passed the Senate by a 62 to 36 bipartisan vote, but a joint House/Senate conference committee appointed to reconcile the differences between this bill and a separate version passed by the House of Representatives (H.R. 4437) was unable to complete its negotiations before Congress adjourned.
Like our nation's religious and civil rights communities, I opposed enforcement-only approaches like H.R. 4437. That House bill is also opposed by the U.S. Chamber of Commerce, the AFL-CIO, the U.S. Conference of Catholic Bishops and over 200 other faith-based, business, labor, religious, local governments, civil rights, and ethnic groups. The common denominator of this opposition is that the bill would have had a profoundly negative impact on workers, on businesses, on families, and on local communities without making the country safer or fixing any part of the broken immigration system.
The President and Congress should look at immigration reform in a comprehensive manner to guarantee both that enforcement and border security are enhanced and that all workers, including immigrant and “guest” workers, are treated fairly and are afforded basic labor protections. This approach will curtail the flow of illegal immigrants into the country, reward work and unite families. I look forward to continuing to work with President Bush, my colleagues in Congress, and the people of Illinois on this important challenge.

I have EAD for couple of years & when I moved to Ohio, I was issued 4 years DL. They did look at I-94 (I travelled on AP having one year validaty on I-94), also they DID NOT looked at my EAD expiry date..They asked very simple question - Do you have your SSN? Thats it..!
C'mon...Guys, come to Ohio..you will get DL for 4 years..

Hi in case of emergency also one can go to nearest USCIS center and request for AP. I consider this as an emergency also. Request for an urgent AP and they can generate one in less than a week. I think then all of you can go and get wedding cert from India.
I still think...that by being here you can do the following:
1. See if your marriage was registered. If yes then you can get cert from ADM there. If not then tell the ADM office to write on official letter head that both of you got married but marriage was not registered.
2. Also in that case get affidavits from your parents and her parents mentioning the date, day, place of marriage. These will be 4 affidavits. They also should mention that they did not register the marriage at that time.
3. See if you have photos. Get them scanned and take a colored print and get it notarized from magistrate there in India or here.

I-102 will not work you need to file I-539 for extension of I-94.
I-102 is for replacement I-94.
I am sorry but the rules clearly state that passport needs to be 6 months beyond the intendent travel period.
Unfortunately for H1 that could mean several months or 2-3 years.
fork up $300 unless you plan to be put of status or can find a cheaper way of flying out to Mexico/canada and flying back in.

Is it NSC or TSC?
Not sure about the purpose of this site but mine was applied on 29th April. Started seeing updates after 15th May. Got the approval update around 25th and cards on 7th (except that sp far all cards for me and my family used to arrive at same day this time they arrived on diffrerent days).

The only reason I want to still enter on H4 is that my H4 is stamped until 2010, hence why not use it and save money and hassle on AP entry. As you have said that working on EAD immediately invalidates the H4 status. This is OK for me, but at least I have avoided the AP procedure stuff. Plus the primary applicant is on H1 and hence we both can enter on H1 and H4 respectively rather than one entering on H1 and the other on AP. Let me know if this clears your doubt and if so, can you think this would work out. Also, if you can, please respond to my other questions

There is no hassle when one enters on AP. You can continue to be on H1 and enter on H visa, and your wife can work on EAD and enter US using AP.
For all the questions that you have posted, the simple logic to follow, is once you use EAD, your H4 is invalid. Once you travel abroad and want to re-enter with H4 status, you are basically stating that you are going to comply with the immigration rules pertaining to H4 status. And then after entering you want to use EAD, then it would invalidate H4.
I suggest you consult a good immigration attorney.

Exactly but mere emphasis solely on educational qualification is unfortunate as after few years in job market, your skills & experience has more leverage than the degree and I am saying this based on my personal experience. In our group I was the one with least amount of formal education but still I got promoted 2 times ahead of Masters degree holders form US and foreign universities.
The issue here is, USCIS is a government agency. They are incapable of making a subjective determination of a person's capability. All they go by is the degree certificate which can be seen on a piece of paper.

I have filed 140 and 485 in July 2006, EB2 file concurrent at Nebraska service center. So far no word yet.

I have a similar question. I have I-94 till Jan 2008 as my H1B visa is valid till Jan 2008. If I file an H1B extension in Dec, is that okay ? I know, approval would not come before Jan 08.

I know there will be many people who are working on their employer's payroll but keeping maximum share of their rate.
I have my EAD and i want to switch my current company and move to a new
one as my current company is keeping around 20% share.
I am thinking of the following options:
1st option) I have my Canadian PR and thinking of an option to join the current vendor directly. Incase my 485 is rejected, then i can move to Canada.
In this case, i do not know how to run the paycheck and other related stuff to stay out of trouble for my current 485 processing.
2nd Option) I can find an employer who will just keep around 5/hr from my share and keep me on their payroll. I can also keep myself on my H1b by having my H1 transfer done. I will take care of running the payroll from a third party.
In this option i dont have to worry much as company will show me on its payroll and my H1b will be valid.
I would appreciate response from people on this forum. I know someone might be doing it right now.
Please suggest pros/cons of the above options.

Why every discussion has to end with donate - why donate? What IV has done so far? Where the money goes? EB2 vs EB3... etc. Stop hijacking threads.
By the way, the title of this thread is of no good. Don't give such title to generate clicks, your post is not a media news site to give misleading titles to generate clicks. "Whats happening with EAD delays" would have been more appropriate.
Every discussion gravitates towards donation because at the end of the day, the reality is that there is a need to mobilize funds, to take our game to the next level.
At the same time, there is a whole bunch of immigrants waiting in the queue for 5,7,10 years, passively, just talking, who could have easily contributed $25 per month to create a momentum for us.
All this complaining about transparency (knowing or not knowing that not-for-profit organizations need to follow very strict accounting and disclosure rules), is just not productive. I would rather put my trust in a bunch of fellow immigrants who are trying to help us all collectively.
Even if nothing comes out of it, I would have tried to push my luck through this group, rather than sitting and waiting for things to change on their own.
Disclaimer: I am not a part of the core or any peripheral group of IV. I am just like everyone else, but have decided to try my bit by contributing.

There's a EB3 140 approval drought in not just NSC, but TSC too. I think it's going to get worse with EB3 becoming U. I am myself EB3 Mar 2005 and my job isn't looking very stable after my company resorted to outsourcing.
Can we suggest to AILA reinstatement of premium processing for those who've waited beyond some acceptable period of time? The same way they are doing for people whose H1's are at the brink of expiration.
I don't see any other way they will ever give heed to this problem i.e. where no monetary gains are involved.
How do you want to contact AILA - why they should suddenly listen to a bunch of 10 stray immigrants like you , me ??

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 quota problems, GC backlog processing etc.
Any other thoughts from your side would help.
Suggestion: Let Corporate America handle H1B quota. They don't need our help. Tying up H1B with GC is only hurting us. We are in IV for GC issues.

It seems that they are scared as if as soon as they would dial the lawmaker�s phone number, the cops standing outside their office will simple arrest them to deport before tonight. People, open your eye, we are in AMERICA. This is Democracy, you are expected to tell the lawmakers about your definition of fairness and how you have been treated unfairly. It is our responsibility to tell lawmakers about what is �unfair�. 100+435 men/women in DC want to listen, the only problem is we don't want to speak to them. Most of our fellow forum members think that simply whining on the forums will make the problem go away.
