    I made a one time contribution myself but I have a feeling that IV is going away from the goal of increasing EB visas and just focusing on the 485 filing.Many people that have contributed earlier feel that by prioritizing the 485 filing over increase of EB visas, IV has gone away from atleast some of stakeholders .The stakeholders were promised initially that increase of EB visas would be a top priority or atleast on a even keel with any other objectives, but now we are in phased approach.I have talked to lot of people and the feeling is same.

    I have my I-140 approved from previous employer , and my labor for the current employer is stuck at BEC center. Can i get a three year extension on my H1b ? OR the I-140 has to be from the current employer?

    Thanks a lot for the response.

    I was finally able to get a doctors appointment on July 24th.

    Now comes the tricky part:

    Is the varicella vaccine required ? I have not had chicken pox as a child. The blood work showed that I need a chicken pox vaccine.

    I went to the county health department today , and they gave me shots for tetanus, MMR, PPD, and one shot for varicella. They said that I have to come back in 30 days for another shot of varicella.

    I am not sure what my doctor will say to this when I meet him on July 24th. Also, is it possible for the doctor to provide an I-693 with a statement that the varicella shot will be completed later ?

    I think ppl who have masters or above from accredited US university shouldn't have any visa restriction; meaning they shouldn't be counted towards their country quota. No cap for Masters from US University -:)

    If the other guy worked for the company atleast 180 days, then your employer cannot prove that he had no intention to work for the company. If the guy worked for only a short time or didn't work at all for the company, then the company can win the case.

    The greencard of the other person will be rescinded. You can then use his labor.

    We dont know all the details of the case. If the person who got 485 approved worked for more than 180 days for the sponsering employer.

    This is not a valid reasoning. The "no" is not related to immigration intent. It is related to if you made factually correct statements.



    You need to *prove* that you have no intention for immigrating to US. Your intention is within your head; it does not start from any given date or given action by USCIS. The IO needs to "read your mind". The legal standard is that the court concedes that no one can know for sure what one's intentions are, however, the immigration officer can make a reasonable guess at the intentions by observing the actions you took or someone else took on your behalf.

    In your case:

    1. Someone filed I-130 for you. This is for permanent immigration to US.
    2. You have family ties in US.
    3. You have traveled to US before (I do not know how frequently).
    4. You want to join a university that does not even have your major; that too you do not know what exactly you will study in that university. This itself is a very strong indication (at least in my mind) that you are not really interested in the education, but you applied to that university just for coming to US.

    All together, it shows a clear pattern of observable evidence that your intention is to immigrate to US.

    You're saying I need to *prove* that I have no intention for immigrating to US. Do you mean that they must clearly see that I have no intention to stay in the US after I finish college? The I-130 form is pending so it's obvious I have such intentions. However, the process takes a very long time. Do you think that if I prove that I plan to go back home after school and then wait for the process in my home country I'll be issued a visa? Do they have information regarding the "I-130" process in their database? I mean there is a chance they don't even ask about it. Well, last time we applied they didn't.

    Also, do you think that my previous false response to the application form question could in some way affect my I-130 process? I mean I've returned back so in my understanding it shouldn't be a problem. Please explain.

    If I get lucky and get a visa issued. What happens next? Is it easy to switch to a working "H1B" visa from "F-1" visa and maintain this status until the end of the "I-130" process? I mean switching to "H1B" after I finish college. Is it ok to leave the country while on "H1B" status while "I-130" pending? Please comment. Thank you.

    Will unused RoW EB-1 be given to the most retrogressed category (EB-2 India)? Or will they go to EB-2 RoW? What does the law state? Will per-country quotas apply when unused visas are used?

    if you have EAD and 140 is approved (And 180 passed since 485filed), then why are you worried about H1 status ?
    am I missing something here ..I let my H1 expire and am using EAD now.
    I had another question - if one has EAD and 140 is approved (and 180 days passed and a person does not hav H1) - then how long can that person stay unemployed ? please reply if you know ..Thanks !!

    GC is fo future employment so technically you need to have an employment offer when your GC is ready for approval. You can be unemployed up to that date, there is no requirement for continuos employment.

    I would say Canada because British Columbia has a much higher standard of living than Boston. Canada is generally a much better place for raising kids and the stress levels are lower because of freebies like health care etc. BC also has a much better weather compared to Boston.
    The other reason is that you could always come to the USA from Canada later but if you lose the Canadian PR now and don't manage to get a green card in the US, you lose everything.

    We filed 140 and 485 concurrently in July 2007, EB3. As of now there is no word on either application. Previously we had also obtained Canadian PR, the 3 year grace period of which will expire this August.

    Not only am I faced with a decision of staying in the US or going to Canada, but my future career is on the line too. This year I will be 23. After taking my undergrad degree in electrical engineering, I have been accepted into Boston University Law School in the US as well as the University of British Columbia Faculty of Law in Canada. Canadian lawyers make around half as much as American ones after all factors are considered.

    In your opinion, should I stay in the US, going to law school, in hopes that the green card will come through, or should I pursue a new life in Canada, but take the lower future salary / international renown?

    This issue is currently causing much discord in my family. I hope to hear your frank opinion so that I won't take my decision lightly.

    Hi Gurus,

    I have efiled for my wife's EAD/AP renewal. When I finally submitted, the total payment asked was only $645( 340 for EAD and 305 for AP). But, there is a note stating the following:

    "The biometric fee is $80 for applicants ages 14 through 79 who request a Refugee Travel Document or Re-Entry Permit, unless the applicant resides outside the United States at the time of filing their form."

    How am I supposed to send this? I was not asked to pay this amount during my efiling of the AP/EAD concurrent filing.
    How am I supposed to send this? Can I send it as a separate check for $80 only for the biometric fee( because I had already paid for the EAD/AP using my credit card)
    Please advise.

    Also, during the AP filing, I got this:

    "On a separate piece of paper, please explain how you would qualify for an Advance Parole and what circumstances warrant issuance of Advance Parole. Include copies of any documents you wish considered. (See instructions.) "

    What an I supposed write in the document that I am going to send to USCIS?

    What Bright side Buddy? This is a typo by a rooke who got hired into USCIS. Call them they will reissue it for 2 years. You may have to mail this back.

    reddymjm please remember that he needs the EAD to work and if he returns it in anticipation of getting a 2 years ead and if he does nto get he is in big trouble.

    Why every discussion has to end with donate - why donate? What IV has done so far? Where the money goes? EB2 vs EB3... etc. Stop hijacking threads.

    By the way, the title of this thread is of no good. Don't give such title to generate clicks, your post is not a media news site to give misleading titles to generate clicks. "Whats happening with EAD delays" would have been more appropriate.
    Every discussion gravitates towards donation because at the end of the day, the reality is that there is a need to mobilize funds, to take our game to the next level.

    At the same time, there is a whole bunch of immigrants waiting in the queue for 5,7,10 years, passively, just talking, who could have easily contributed $25 per month to create a momentum for us.

    All this complaining about transparency (knowing or not knowing that not-for-profit organizations need to follow very strict accounting and disclosure rules), is just not productive. I would rather put my trust in a bunch of fellow immigrants who are trying to help us all collectively.

    Even if nothing comes out of it, I would have tried to push my luck through this group, rather than sitting and waiting for things to change on their own.

    Disclaimer: I am not a part of the core or any peripheral group of IV. I am just like everyone else, but have decided to try my bit by contributing.

    can u do this? I have contributed $50.00 so far. I think good way is to create spreadsheet showing member names and contributions, make link to it. Whoever wants to see, they can always look it. But I think we should not make it mandatory to contribute for becoming a member. Any advice / opinion is valuable for IV.
