    I do not know how feasible this is, but if in your employment letter, there is a description of responsibilities, and additionally a statement like: "The job being offered to XXX falls under O-NET classification 15-1031," then you are completely covered, because the employer is positing that the job being offered to you falls under that classification. Again, don't emphasize technologies etc., just the job description and mainly classification.

    The AC21 language is very clear: "same or similar occupational classification"

    It does not say job responsibilities or job title. These are interpretations of that term and used to DETERMINE the occupational classification. So as long as the occupational classification matches or is similar, you should be fine.

    Also, the O-NET classification is from SOC which stands for "standard OCCUPATIONAL CLASSIFICATION." It can't get any clearer than that :-)

    As always, my cautionary statement: I am not a lawyer, just applying common sense interpretation to the terms.

    In that case, both my old and new job (responsibilities and titles) fall under 15-1031.00 if we take into consideration a broader classification where job duties are the same but technologies are probably 60% same but some technologies mentioned in my L/C are obsolete and my current employer does not list those technologies.

    My wife travelled to India via Munich (Lufthansa) in Feb end and she had no issues with transit visa. She was never asked about it. The I-94 had expired and we have a valid AP and approved H1 (unstamped). She has not returned yet, so any requirement on return journey is untested.

    I was nervous before she left and was wondering if I need a transit visa for her. Thanks everyone who posted their experiences.

    That post was intended towards EB3 category, particularly EB3-India. Ever since starting of this Fiscal Year there are very few EB3-India approvals (Can anybody dispute that?). So how come USCIS used up all the visas already?? Most of the guys here always talk about EB2-India which is not highly effected category in the first place. We suppose to be taking care of effected categories.

    How do you know there have been very few EB3 approvals? There is no tracker accurate enough for us to know that.

    Hi,

    I filed I485 and my I140 got cleared. My employer is not willing to give my Approved I140. I am not sure why he is holding my I140. I dont have have any idea to change job at this time.

    WOW --Right from relationship between coutries tot he pros and cons of war planes we are discussing here.We have people with nice political knowledge per se Ministers and Kings who can analyze how just 11 billion (bully)dollar deal can affect the Green card processing and we have Generals and colonels who knows which fghter plane is good for which country.

    But still we are able to manage only around 200 for the advocasy event and large amount of donataions which barely met the expenses. what a pity ;)

    The first thing to do in call your attorney and ask him to be with you when any uscis or ice guy shows up. Right to an attorney is a basic right. Do not think that u will offend ice officer if u have u'r attorney present. Do not think that u'r charming personality will put u in the good books of ice. If I were u, I would not do anything, without consulting my attorney in such a matter.

    Also, keep bank stmts and all recent paystubs handy, along with past exp. Letters and degree/certificates. Copiew of h1 + gc petition/approval would be good to have.

    I have one week from now for his visit. He gave me his desk number too. So I guess he is still an ICE employee. I did not call him at that number though.

    You would think you could influence the Americans to support your cause and vote accordingly in the elections. FORGET IT!! Let alone the 2nd, 3rd, 4th.......17th generation American citizens, even the recently naturalized immigrants don't give a crap about us immigrants. The media and the politicians just have a field time with the immigrants (both legal and illegal) and some ignorant and dumb Americans (who don't usually vote) who get easily carried away by the emotions played both for and against immigration.

    The serious voters (this has been established by several polls) however, are quite aware that immigrants are not given relief and naturalized overnight and are obviously confident that it could take around 20 years for any immigrant to get naturalized. The issues for these serious voters are: Iraq war, economy (the dwindling housing market?), globalization, gay marriage, abortion, and imports from China.

    I wish good luck for IV and all those participating at the DC rally. NO, I can't make it, I am sorry.

    A very pessimistic and inaccurate outlook.

    If this was indeed true, there would have been no Ac21 act back in 2000. No PERM system would have been created to replace the cranky RIR system. The July 2007 visa bulletin would not have been reversed. Just look back at the last 10 years and see how many changes have happened in the system. Believe me, if apathy was their attitude, they would not have implemented any of the above and their inaction would not have impacted them in any way.

    Having said that, I must also caution some over-enthusiastic people who believe a walk in DC will solve all their immigration problems. We all certainly hope something will happen, but we should not be distraught if nothing happens. We just need to keep pushing instead of talking on a defeatist attitude due to setting wrong expectations out of one single rally.

    You dont need to knock anyones door - I'll proactively go to anyone who used a "Labor Subs" and call them a Cheat because they have cheated someone else's Property and Dream.

    Its gone but i'm personally a victim of that - My 1st Labor was traded in the Market for certain US dollars... The legislation was not there - otherwise i did have sufficient Proof and resources to take care of that cheat company.

    How could you talk in support of a evil legacy system ? :mad:

    No one knocked your door and and asked your personal opinion ....and no one cares for what you care ...

    The law seems to have changes due to AC21, I don't think we can get any actual data of any one who got his GC after AC21 and has already converted to citizenship.

    It would be really great if IV can contact USCIS and get an official guideline on this topic.

    Once the dollar touches that low, expect huge salary cuts across the board for the employess of these companies.

    I wish they invested in R and D and innovation and products instead of services. Service industry is mainly governed by dealing with cost efficient labor. These companies reach out to IITs IIMs get the best and brightest and dump them into the service sector and start earning on them.

    If they changed their business modal and started investing in products and Rand D, it may not give them quick money, but the results will be beneficial on the long run.

    I am in exact same situation. The company that is going to sponsor my H1 checked with two attorneys and both said that I will need a fresh H1 in April07 and I can start working from Oct07. Even I never got to work on my earlier H1. I guess this is because you need previous paystubs for H1 transfer. Let me know if you hear otherwise from your attorneys.

    Guys, Thank you all for the support. I have responded with the same kindness.

    And for those who gave reds, I always thought in spite of the gloominess, we still want to ponder at what the new bulletin has is in store. Anyways, thanks to you all too. Have now learnt that discussing future VBs has become a Taboo.

    There's always two sides of a coin. Don't think much about people who gave you red but there were also people who gave you green. And in this forum red and green means nothing.

    It's just that some frustrated souls gives you RED and some relaxed souls give you GREEN.

    There were some frustrated souls out there who gives you RED for everything, who doesn't add any value to this forum.

    And I bet even I would get for this comment.

    This is my first post. I had filed 485/140 in Aug. 2007. 140 got approved this March 2008. I donot have pay stub for last 3 months. I am looking for change. My labor is a substituted one( PD 2004). It has skills mentioned of Oracle EBS. I am working on Java/J2EE. I am looking for a new Job with Java/J2EE skills. I am worried that my new offer letter with Java skills mentioned would create a problem for me.

    Please Gurus, can you advice me as to whether I can do that? Will staying on bench create a problem, as I donot get salary on bench.

    Please help me.
