This is one critical thing that USCIS must consider.....USCIS must have another way to handle EAD applicants with H1 or L1 and fast-lane for those without. H1 and L1 applicants (except those expiring soon and no more chance to renew) do not need EAD immediately while those without H1 or L1 needs it immediately.

The company I work for in USA has a India Office.
That office paid the exact NEW fees through HDFC.
They then couriered the HDFC receipts to my home in India.
I arrived in my city.
Went to VFS office, submitted the required doc's.
They created the courier package which is used to send the passport back.
After few days I went to the US consulate as per my scheduled appointment.
I use the VFS lounge service which helps because I had luggage etc.
It was quite a smooth process in Mumbai, except that it took 2 hours of waiting.
My 9:30 appt actually happened at 11:45.....
But yes, there were many many people who had demand draft's in their hand, either of full fees or the difference.....

Only My wife has got a medical RFE.
It talks about going to original civil surgeon and getting a TB test again and a Xray.
Did you face a similar situation as ours?
If yes can you throw some light on how to proceed.
I cannot go to the same surgeon since I live very far now.
Also worried why they have generated this RFE when I had submitted everything properly!
Anyways any guidance provided is much appreciated.

Yes we have received a similar RFE and can no longer go back to original civil surgeon. USCIS is very anal about TB test so if they don't get correctly documented result they issue an RFE. As per my lawyer many people are getting this type of RFE.

My suggestion will be to check with your local civil surgeon how he is willing to proceed. Most civil surgeons are not comfortable with signing documents for which someone else and would do the test again.

PD for family based visa is based on the date you file your I-130 for your Spouse. Nothing to do with the Labor certification.
For unmarried sons and daughters of GC holder same PD is given as of parent - I saw couple of documents.
I am not sure about (2A) cases.

The fact that the National Governors Association has also endorsed "Comprehensive" reform (besides the RNC last month) strengthens the case..
What is more important for us is that they also endorsed funding for the EB immigration system. See the highlighted portion below...

Janet Napolitano at a meeting of the Western Governor's Association, is calling for legislation to "protect and preserve the safety and interests" of the United States while also recognizing the need for "Western industries to have a stable and legal supply of workers," according to a release provided in advance of the meeting.
"Our states are on the front lines of a tidal wave of illegal immigration," Huntsman says in the release. "The debate in Washington has been polarizing and unhealthy, and we are asking the administration and Congress to adopt this bipartisan framework and recommendations agreed to by the Western Governors' Association."
Immigration has been one of the top issues of the National Governors Association as state leaders huddle in Washington.
While Congress has passed one immigration bill, there have been calls for more stringent and more comprehensive legislation from several sides of the immigration debate.
And increasingly, states are leading the charge, with Arizona and New Mexico both declaring states of emergency because of the influx of illegal immigrants.
"Governors feel they have to get into this debate because of the lack of action on the federal level in the first place," says Kirk Jowers, director of the University of Utah's Hinckley Institute of Politics, "and this issue so impacts the governors at the state level that they've decided they need to be a catalyst for this reform."
The proposal by Huntsman and Napolitano also calls for the U.S. leaders to work with Mexican and Latin American governments to "generate economic growth, improve the standard of living and promote ownership" in those countries as a way to stem the tide of immigration to the United States. My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

They are very smart. They know your weaknesses. Unless all so called high skilled use their little skill and go to the street and ask for justice, they will favor illegals. We don't have God fathers !!

I just don't understand one basic question.
Congress is trying to pardon 12 million illegals as a one time measure and give them Green Cards. (OK - Very good)
On the other hand we are about half a million who entered the country legally and helping the U.S. economy and paying taxes. Why don't they consider giving all of us Green Cards as a one time measure too ?????

So I am in some real mess ....
I married to a gal in 2007 during my visit to my home country but it did not work out b/w her and me due to some family reasons. (Not divorced just separated)
I came back to US in 2008 and applied for 485. My green card got approved and now my wife is in my home country and I am in US.
Now my wife and I have reconciled and I want to bring her to US.
Can I apply for her Green card and bring back to US ASAP w/o waiting for 5 years as I married before approval of my GC. I can get papers from my home country showing that I got married way before my GC approval.
I did not show at any stage in GC application that I was ever married. I thought the marriage is gone so why show it and now it could hurt me. I even dont remember if there was any question regarding marital status on 485 application.

Do not give up your green card. You must explore all options before doing that. Your best chance will be to get her here on a F-1 visa. If she is qualified, H1-B is appropriate but these days it's not easy to get H1-B. As far as i know, once your green card is approved you may not be able to add your spouse. Anyways, it would be best to consult an attorney like murthy and if possible use their services. They know the rules and most probably USCIS knows murthy too.

I agree that IV should be focused, but this doesn't mean that all the tasks within that focus group need to be worked on in one go. I was just suggesting that excluding dependents from visa numbers is something that we can probably add to a forthcoming bill. Or at the very least, let dependents file for I-485 without the requirement that PD of the primary applicant be current. Just think about it, the main reason why the majority of the members are happy now is because they expect to get EADs for their spouses so they can start working, not because their GCs will be obtained any sooner. Let's not forget a potentially sizable portion of our member base (whether they have already contributed is another matter, this might actually inspire them all to contribute) who while thankful to IV are unsure of what lies ahead for them and their (future) spouses.
And yes, my sympathies out to the labor backlog victims too. With hundreds of thousands of people applying for their AOS now, I wonder when they would be able to file for their I485 at all. The same question is being asked by many singles as well.

I just talked to our company lawyer and she said that they are seeing a lot of 485 approvals from the receipt dates from last week of july and a little before that ...

- A person is on his 5th Year of H1 and his I-485 gets rejected - he can go back to H1 (Since he has 1 year left).
- A person has exhausted his 6 years (May be in his 7th year). Now his I-485 gets rejected - he cannot go back to H1 (Since he has exhausted his 6 years on H1).
Not sure if my understanding is right here
