I know of a colleague who lost her father but could not go to perform the last rites because she did not have the H1 stamped and the earliest appointment that any consulate in India was giving her was 4 months away.
She should have tried through the emergency quota/appoinment to get her stamping.. Death in immediate family is a accepted for this and I know a colleague you had to go for India for the very same reason, death in the family and returned back after getting his stamping. Got his appointment through EQ.
The article posted is touching, but out lives are not that bad .. We are far more better and we do have a good life.

When we apply 1st time they are asking all the documents which is fine.
When we apply Extension they are asking all the details with Paystubs,client letter.
When we apply Transfer they are asking all the details with Paystubs.

2. Documents are needed to demonstrate that offered job is of specialty occupation and the beneficiary meets job qualification. It also has checks for employer who is offering H-1B job.
3. Pay stubs are needed so as to prove that beneficiary is maintaining valid H-1B status when another H-1B petition is filed.
4. Client Letter is needed so that Employer (petitioner) can demonstrate that the proffered position qualifies as a specialty occupation, or that the petitioner has complied with the terms and conditions of the LCA.

IAF - You mean you files your eb2 case with three year degree?
When did you file? did you labor approved?
could you give me an example, how you changed your role and responsibilities for eb2?
If your eb2 gets denied, hope you have eb3 keep running as it is right?

Please don't travel thru countries that impose this ridiculous transit Visa requirement on individuals, especially from India. Ask them to justify the charges, and you would get no response from them.
So, even if takes to spend $200 - 300 more, AVOID these crook countries that charge Transit Visa. People we must send the message across. In this century, I think its Indians that are traveling the most on these trans-atlantic-asia route, and collectively avoiding these 'snob' countries would send a very good signal.
If you are buying the transit visa, your dignity is at stake. Its like saying buying insurance for a person who is poor. They dont charge for countries that are more developed. so, AVOID AVOID these countries.
I am traveling to India soon, and I am going thru Brussels not because I got a cheap ticket, but because there is no transit visa required there.
I had to apply for UK transit visa last time I went to India (air india). This time I am taking non-stop Chicago to Delhi. I agree about avoiding countries that require transit visa.

I got my FP done on 11/21.I did open a SR on 10/05, based on which I got my FP notice on 11/06.
My details:
485 filed at NSC on July 6th
Receipting done by CSC on 09/05, EAD and AP sent by CSC
485 pending at NSC
Looks like they have started the FPs for transferred cases like ours...
I haven't got my FP Notice yet! No SR opened.
Is there any NSC-CSC-NSC filer who got FP notice without opening a SR?

Divide this 28.6% into 4 quarters/12 months so each quater/month has some quota.
If divide into 4, each category has 7.15% quota in each quarter.
There's limitation for each country.
Each quarter, when a country hits the limitation, cut-off date shows up to make sure no more applicant processed for that country.
Back to the old time, unused quota after 4th quarter are going to trash can, despite there's cut-off date for certain country or certain category.
In 4th quarter of 2007, according to USCIS, To not waste the quota, they set every category current. In this case, they process your application randomly or according to the receive date to USCIS regardless your EB category or country.
So very likely unused EB-1 quota go to EB-2 ROW, not China/India/... if the country limit is hit. If the country limit is not hit, EB-1 quota is for EB-1 until EB-1 for every country is current. There's no EB-1 ROW quota or EB-1 India quota.
Hopefully, at the 4th quarter, they will push a big forward again(but please don't do current in every category again, that is a mess) to ensure the quota for the year is fully used and not going to trashcan. And that opportunity is even to everyone if they pick up the case with in the cut off date randomly regardless receiving date and country. Completely agreee with hari_baby22. I'll throw in my two cents and speak on behalf of the 300D. Though it does not have a metal body or a few other features found in the 10D and others, I find it to be a well-built camera that is more than meeting my needs. I have yet to be disappointed. Of course, if someone walks up to me today and offers to trade a MKII straight up for my 300D, I'll gladly give it up. ;)

I have recently moved out of state and started on a different job. I updated my address with USCIS online last week. I just got a email from CRIS for RFE. I have I-140 has been approved since 2004 and applied for I-485 in July 07. My lawyer is from Frogman firm. This was the firm used by my GC sponsor employer. My new position is slight different from Software Developer to Lead System Analyst. I think this should be covered with same or similar clause.
If you have prior experience please let me what to expect and do any preparation now itself.

My wife AP online status said Sep 11 th. We received them on Sep 21 st.
What is the normal time frame for receiving AP papers?
My wife's AP papers were mailed on 17th Sep but we are still waiting for them.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

Just think how it feels to be waiting for receipt notices, knowing people who filed in late June are still getting them (and only a couple of July 2nd filers so far)and also knowing that if something is wrong with ur application, its going to take years before you can apply again....and compare it to the additional 2 months u r going to wait for ur EAD/AP

So, does that mean there's no need to invoke AC21 after you get you get EAD, if you want to change employer before 180 days of your filing?
if you change your employer within 180 days of 485 RD, the employer can revoke your 140 which will invalidate your 485.
After 180 days you can switch using your H-1 too. The EAD is not necessary.

I have a total of 15+ yrs exp in the IT industry out of which 8 yrs in USA. I am also an EB3 :) BTW I have a 4 yr engg degree from a small college in india :p

I am totally pissed off with this system. The only wrong step which i took was applying in EB3 when i had three years of experience. Now i have a total almost 10 years experience in IT and still waiting like an illegal immigrant for GC.
