Not sure if I will make the category, but feel that I should consult with a good immigration attorney and explore the option. Who knows? I wish there was a category for people who were doing the work that directly improved the lot of the American people. Not-for-profit is not lucrative nor glamorous, so there should be some incentives :)

Hello guys,
I came to US to pursue masters, and have started working on H1b while working on my thesis in parallel. Meanwhile my advisor did not get his tenure approved, and had to leave the university. So I had to abandon my thesis work, and had to register for extra courses. My employer and the client I work for are okay to let me go to university for 2 months, but my employer did not pay me for the period (no paystubs for this period). So my year-end wages fell short of the LCA amount.
I know that unpaid leave is not legal while on bench, but since I took the leave while I was actually on a project, does anybody think mine is a genuine case, if there is any such thing??
I am looking to go for stamping, and is really urgent

as they lottery notification papers tell you - continue with all other immigration petitions.
the petitions are completely separate - take the GC with the petition that is adjudicated first and that's what I plan to do.

Hi all,

Hi,
I need some clarification regarding my case,
--> Got H1b approved for Employer A in 2008, during stamping received 221G.
--> Submitted documents in 2009 and got stamping done in May 2009.
--> Now Employer B has applied for fresh H1B 2010.
My questions are,
When my petition is approved and having the petition in my hand, do i need to get the visa stamping before travelling for Employer B?:mad:
Will my visa stamp for Employer B only have the starting date to be from October 2011?:mad:
Is there any remote possibility that i can travel for my Employer B at any time earlier to October 2011?:mad:
Note: Have never travelled on H1 (Employer A's Petition)

Yes, COBRA is no problem and has nothing to do with your H1B / EAD / GC status.

"It was reported to us that your IP address or internet gateway has been locked out for a select period of time. This is due to an unusually high rate of use. In order to avoid this issue, please create a Customer account (single applicant) or a Representative account (representing many individuals)."
I am logging in after many days and I was checking it for the first time today

I am on H1-B and have an EAD. My Dad is a builder in Hyderabad and I want to promote the apartments in US. Can I rent an office space and just do marketing without registering a business? All sales will be completed in India.

Your friend has to wait till he gets his citizenship. A GC holder can only sponsor someone to visit, but can't sponsor another person for GC. A citizen surely can. I heard that an immigrant could apply to USCIS to grant spouse also a GC based on hardship grounds. But I would not bet on largesse of USCIS. It is a headache dealing with bureaucrats, lawyers and appeals.
If your friend had a traditional marriage (Church/Temple/Mosque etc ...) and not registered it or just an engagement, it should be fine. There is a risk that your friend's (would-be) wife might be denied entry into USA based on marriage to an immigrant. F-1 VISA holders are not supposed to have immigration intent.
Once his (would-be) wife lands here, your friend should have a registered marriage in USA. She has to continue on F-1 VISA till he gets his Citizenship.
There was a V VISA provision which expired as of December 2001 or 2000. This would have allowed GC holders to bring their spouses on V VISA. Ask your friend to join the groups which campaign for this provision. :)

Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?
Firstly, very sorry for your situation. Seems to be very tricky. I am no lawyer so take my .2 cents with a pinch of salt. I think you are intertwining two separate issues. FMLA may protect you during maternity leave (you need to read the act to see if you qualify) BUT USCIS not approving your petition has nothing to do with your pregnancy neither does your employer. Your employer can terminate you on the basis of non-approval of your H1 not that he is doing because of your pregnancy.

Looks like the long awaited spending bill is finally in the making and should make its way to the congress soon. For those of you who haven't contributed to IV, this should come as a warning that if you don't contribute now, it may just be too late for us to seek any relief in these bills.
Once this opportunity has passed, we'll be stuck with CIR which everyone knows is a tough pill to swallow for either party in the congress and could drag on for months and may never see the light of the day. So here are the choices:
1. Contribute now and try to get some relief from these spending bills.
2. Contribute later and try to get something done with CIR/SKIL.
3. Never contribute and just watch core members pull their hair trying to figure out why people are not contributing and just hope that GC will fall from sky.
Whatever you chose to do, please think twice before you make up your mind.

Has anyone been able to call USCIS premium processing toll free number today and talk to an Officer. I have been unable to get to an Officer today but was able to talk before. I am wondering whether there is a limit on how many times you can call(I have called 3 times so far in 10 days) or if you can't call after so many days have passed after your application is approved.
I have been contacting to get my priority date corrected on I-140 approval. Please respond if anyone has information
