Nikon put itself "On The Ropes", by not paying attention to what the market wants. Canon have consistently caught them with their pants down with the D60, 300D and the mkII. Very kind of Canon to leave Nikon anywhere near 30% of the table scraps. who says the blokes at Canon don't have a heart?

With current situation in economy, I don't think our HR 5882 will be in the mark uplist. US govt has bigger problems than spending time for "recapture EB visas". I have no hope of recapture bill will be discussed near future. Sorry for my pesimistic views
As much as I am disheartened with current situation regarding EB visas, I am more disheartened by this give up attitude...
For all folks who do not act because of pessimistic views, please don't take this personally. Having pessimistic views are ok as long as they don't get you down so much so that you stop taking actions.

I came to US in 94, and for reasons mentioned in my other postings, I am still in the waiting line for the GC...Compared to me (and may be a few others), most of you guys' situation is much better in terms of the wait. But even though I am disheartened, I never lost hope and the only thing that keeps me going is trying...I may bend, but I will never break...
If you give up for something like GC, imagine how it will when you encounter bigger problems in life...My advice to you my friends is keep trying as long as there is a chance, and as long as there is nothing to lose...

GCPlease - I am also in the same boat! RFE not yet received but looks like it could be for the photos. Its been over 8 days now. I did not get a notice for biometrics. It could be because we did our 485 biometrics just 8 months ago. Perhaps they will just use that.
Should I just send the photos in and see what happens without waiting for the actual RFE? Where did you send the photos? Same address as the docs that you sent?

wait for 15 days since USCIS said they sent you the rfe. After that you can call uscis at the # they have in the EAD Receipt they sent you, and you can open a Service Request for non delivery of the RFE. There is a 15 day rule. if you call earlier, they are not gonna entertain you. I got my RFE after 3 days I opened the SR.
But call immediately after the 15 days because the time limit for you to send the rfe is 33 days and this clock starts from the time they say they have sent you the rfe (which you may have recived in an email notification or the online status). They did not extend this time period for me due to non-delivey.
The RFE they sent had the address we need to send the response. I think it was a different address.
The above said information is based on my experience. It may be be different with each case. you know how uscis is. just use it as a guideline.

Does any one know how mant days it takes to get denail notive .I-140 denied on April 22 and says notice mailed but didnt recieve yet .Both emploter and attorney havent recieved any thing yet .Is this Normal ?
Talash, this is not normal. Your notice could have been lost in the mail. Ask your attorney to contact USCIS and explain. Also employers can request a courtesy copy. So also ask your employer to request one. USCIS will not entertain any request from you, since I140 is a employer filed petition.

I am in 7th year of H1b now..last time my h1b was renewed dates were until April 2008. I went to india in Dec 2006 and came back in Jan 2007. My passport was expiring on Sept 29th 2007 so Immigration officer dated my I-94 until sept 29th 2007 and told me same thing that you can go to any port of entery or international airport and meet USCIS officer and extend your I-94 with your new passport. I waited until last moment and around sept 24th I went to USCIS officer on airport as well as on Port of Entry (called Deffered Inspection site). Both places got answer you need to file extention online because we only correct mistakes and this is not a mistake but it was case of passport expiration. I called my lawyer, my hr, my company lawyer. Everyone told me I cant work after 29th sept as my i-94 is expiring. Thats same as your H1 expiring. SO either leave country and comeback with new stamping or file new h1b. I ended up filing new H1b as i had only couple of days left before my I-94 would have expired. I have filed I-485 and ead and my I-140 is pending. My pd is Dec 2003. As per my lawyer I want be out of status as mY I-485 is pending but I will loose eligibility to work as I wont have any work authorization once my I-94 expires and dont have EAD approved on my hand. Yes, I honestly think that quantity matters in meeting politicians. What is so clear to us may not be clear to them. Not because they are lesser mortals than us, they have a different perspective. Why and How is entirely not up to me to worry about. Someone has a different view and I can only respect that view. I cannot, and do not, think that I must invest my time in brainwashing anyone. I wouldn't call it a crab mentality either without knowing them personally.
With that said, let me be a devils-advocate, if you will, and ask these questions:
Given ours is a issue-based, goal-based struggle, with Goal & Issue being same for ALL EB immigrants:
--- Why should I expect all immigrants to wear any organization's badge, be dedicated to any particular/one organization, whether that Org is IV/Democrats/Republicans/Congress/BJP
--- Shouldn't I be just worried about who can SHOUT louder about my issue and less worried about the Organization that's making them SHOUT?

Yes this a legit reason to get receipts. But if you have been denied receipts by employer/lawyer in recent past. Give this reason a little time, if you know what I mean. Else this reason would also go to waste.
My Lawyer has been good in this regard and usually scans a copy and emails to my HR/Supervisor and Myself as soon as she get any notices/rfe's etc. I think this would be the pattern of most employers if not all.
I have my canadian PR approved and have until Octber 1st to land. I hope my lawyer will get the receipt notice by then. I don't want to lose my Canadian PR and will have to travel to Canada before Oct 1st.
I'll send my employer the proof of my Canadian PR. He kinda already knows that I have Canadian PR and have to land shortly.
Hopefully they'll give it to me on that request.

Just to add, this is the risk of not working for the company after getting the EAD. The employer can easily prove that the person had no intention of working for the company. AC21 cannot protect that person.
the guy who used AC21 got his GC and rightfully so since he left after 6 months.
Our friend was the one who got the labor sold by his desi employer leech..to him
its good atleast that Ac21 works and it should..now with substitution banned the new AC21s will be protected..as long as they didn't substitute..
Finally labor substitution was a bad choice! thats the moral of the story..

You should not have quit the job under mere threat of lawsuit esp. when he did not have anything to hold over you anyways, In future, of course, just to be on safer side, send a back dated letter with your resignation and date it to your last working date for that employer that way your 12 month counter starts from that back date..

What does your attorney say? He/she should have had some idea when they filed under EB2. The attorney should clearly not take a risk regarding educational requirements. Maybe you will have to do the MTR and submit better evaulation (if you feel the degree and experience are suitable). Best
